1.1 This website, 3xrmd.com, is operated by 3xRMD Pty Ltd (ACN 702 443 507) ("3xRMD", "we", "us", "our"). These terms apply to your use of the website, including Adam, our website AI Advisor, and the capacity calculator.
1.2 By using the website you agree to these terms. If you do not agree, please do not use it.
1.3 These terms cover the website only. If you engage us to provide services, that engagement will be governed by a separate written agreement. If there is any inconsistency, the separate agreement prevails.
1.4 We may update these terms from time to time by publishing a new version on this page. The version in force when you use the website applies.
2. Information on this website
2.1 The content on this website is general information about our business and services. It is not professional, technical, legal or financial advice, and it does not take your particular circumstances into account.
2.2 Figures produced by the capacity calculator are indicative estimates based only on the numbers you enter. They are not a quote, a forecast, or a promise of any saving or outcome.
2.3 We try to keep the website accurate and current, but we do not guarantee that it is complete, accurate or up to date.
2.4 Product and company names mentioned on this website belong to their respective owners. Mentioning them does not imply any partnership, endorsement or affiliation.
3. Adam, our website AI Advisor
3.1 Adam is an AI system, not a person. His replies are generated automatically and may be inaccurate, incomplete or out of date.
3.2 Adam provides general information and helps you explore ideas. Nothing Adam says is advice, an offer, a quote or a commitment by us, and you should not rely on it as any of those things. Only a person at 3xRMD can make a commitment on our behalf, and only in writing.
3.3 Please do not enter passwords, authentication codes, payment details, sensitive information, or confidential information you are not authorised to share. Our Privacy Policy explains how we handle what you type.
3.4 When using Adam you must not:
- (a) try to make Adam ignore its instructions, reveal its instructions or configuration, or produce content unrelated to our services;
- (b) use Adam to create unlawful, harmful, harassing or misleading content;
- (c) use software to send messages to Adam automatically, or send excessive or repetitive requests; or
- (d) enter content that infringes anyone else's rights.
3.5 We may limit, suspend or withdraw Adam at any time, including by applying usage limits.
4. Our phone line
4.1 Calls to our published numbers are answered by Ava, an AI receptionist. Calls are recorded and transcribed as described in our Privacy Policy. Ava can take a message or transfer your call, but she cannot give advice, give a quote, or agree to anything on our behalf.
5. Using the website
5.1 You must not:
- (a) use the website in a way that breaks any law or infringes anyone's rights;
- (b) interfere with, disrupt or place an unreasonable load on the website or the systems behind it;
- (c) try to gain unauthorised access to any part of the website, or carry out security testing without our written permission;
- (d) introduce viruses or other malicious code; or
- (e) use automated means to scrape or copy the website in bulk, or republish or commercially reuse a substantial part of its content, without our written permission, except as permitted by clause 5.2.
5.2 Search engines and AI search and answer services may crawl, index, cache, summarise and cite the pages of this website, with a link back where their format allows, provided they follow our robots.txt file and do not place an unreasonable load on the website.
6. Enquiries you send us
6.1 Please make sure the information you send through our contact form is accurate and that you are authorised to share it.
6.2 Sending an enquiry does not create a client relationship or any obligation on either of us. Please do not send confidential information until an agreement is in place.
7. Intellectual property
7.1 The 3xRMD name and logo, our sub-brand names (3xRMD Voice, Sales, Service, Flow and Assist), the "DO MORE ×3" signature, and the content and design of this website are owned by or licensed to us.
7.2 You may view, download and print pages for your own information or for your organisation's internal evaluation of our services. Any other use, including reproducing, modifying or republishing our content or using our brand, requires our prior written permission, except as permitted by clause 5.2.
8. Links and third-party services
8.1 The website links to third-party sites, including our social media pages. We are not responsible for their content or practices, and their own terms apply.
9. Availability
9.1 We aim to keep the website available, but we do not promise that it, or Adam, will always be available, uninterrupted or error-free. We may change or remove any part of the website at any time.
10. Consumer law and liability
10.1 Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
10.2 The website is provided free of charge for general information. Subject to clause 10.1, and to the extent permitted by law:
- (a) we are not liable for loss arising from your reliance on general information on the website, on replies generated by Adam, or on estimates produced by the capacity calculator, having regard to the warnings in clauses 2 and 3; and
- (b) we are not liable for any indirect or consequential loss arising from your use of the website.
11. Privacy
11.1 Our Privacy Policy explains how we handle personal information collected through the website, Adam and our phone line.
12. Governing law
12.1 These terms are governed by the laws of Victoria, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Victoria and the courts that hear appeals from them.
